Wrongful Death Claims: What Damages Can Be Recovered?

In evaluating a wrongful death claim, it is important that the family evaluate all the types of damages that might be recovered.  As such, it is imperative that the family consult and retain competent personal injury lawyers to assist them in identifying these additional sources of recovery.

Let’s take a look at the types of damages that are typically recoverable in a wrongful death claim:

  1. Medical and funeral expenses associated with the victim’s death;
  2. Loss of victim’s anticipated earnings;
  3. Loss of retirement benefits such as pension, medical insurance, profit sharing, stock options, etc;
  4. Loss of inheritance on the part of children and other dependents;
  5. Pain and emotional suffering experienced by the family and other survivors;
  6. Loss of care, consortium, protection, companionship of the victim with respect to spouse, children and other survivors;
  7. Other general consequential damages; and,
  8. Punitive or exemplary damages.

Because of the short time limits for filing a suit and the danger that crucial evidence might be lost or destroyed, it is important to act fast.

As laws vary from state to state, it is important to consult with a competent wrongful death lawyer or personal injury law firm to determine which of these types of damages may be recoverable in your state.

Personal Injury Solicitor – Are You Familiar With This Professional?

As I was doing some online research the other day, I just happened to stumble upon a term that I was unfamiliar with – personal injury solicitor. At first reading, it seemed to me like “someone who tries to get people to buy services from the mob” would be a good definition. Apparently, I have a somewhat vivid imagination sometimes. Next thought was – ambulance chasers. It appears that sometimes they are referred to in that manner, and I’m sure for some of them there is good reason for that reference. However, that isn’t what the term really means. It is another term for personal injury lawyer, much like “personal injury attorney” is, as well. I think that there is a distinct possibility that the reason for my unfamiliarity with this term, and possibly others reading this, as well, has more to do with geographical location than anything. The term is used mainly in Europe and I live in America. The wonders of the Internet for learning.
